Terms of Service & Legitimate-Use Clause

These terms regulate access to and operation of LandBech Tool™ within the legal framework of the Right to Repair and the current exemptions of the DMCA. They are complementary to the EULA, the Privacy Policy and the No-Refund Policy.

1 · Acceptance of these terms

Access to, installation of or use of LandBech Tool™ — whether the desktop suite, the web console or any of its associated APIs — implies the full, unconditional and irrevocable acceptance of these Terms of Service, of the End-User License Agreement (EULA), of the Privacy Policy and of the GSM No-Refund Policy. If the technician does not agree with any of these clauses, the technician must abstain from accessing, installing or using the platform.

2 · Legitimate-use clause

LEGITIMATE-USE CLAUSE: The LandBech Tool™ software is designed exclusively for legitimate purposes of technical diagnostics, preventive data backup, firmware maintenance and restoration of factory parameters within the legal framework of the Right to Repair and the current exemptions of the DMCA. The use of this tool to alter the original factory identity (IMEI) of devices that have been reported as stolen, or to carry out unauthorized modifications on telecommunication networks, is strictly forbidden. Any misuse violates the terms of the license and absolutely and irrevocably releases LandBech Tech Solutions and its representatives from any criminal, civil or commercial liability arising from the acts of the operator.

3 · Permitted use

Within the framework of Right to Repair and the active exemptions of the DMCA (in particular, 37 CFR § 201.40 — exemption for technological measures on consumer mobile devices to enable repair, diagnostics and lawful maintenance), LandBech Tool™ may be used for:

  • Forensic diagnostics of mobile hardware (USB enumeration, baseband state, sensor reporting, logcat tracing, battery health, secure partitions, eMMC/UFS readout).
  • Preventive backup of critical partitions (efs, persist, modemst1/2, frp, nvram, boot, recovery) prior to any writing protocol.
  • Verified firmware restoration sourced from official manufacturer servers (Samsung FUS, Apple IPSW signed, Google factory images dl.google.com, Xiaomi miuirom.org official) for legitimately-owned equipment.
  • Authorized network-unlock operations (carrier-unlock, NCK, eligible Samsung KG, eligible T-Mobile Device Unlock) using IMEIs which the technician has the legal right to operate.
  • Restoration of factory parameters and recovery of the device for the legitimate owner, including FRP/account-lock removal procedures over equipment with proof of ownership signed by the customer.

4 · Prohibited use

The following uses are absolutely forbidden, constitute immediate cause of revocation of the license and may give rise to criminal, civil or administrative responsibility against the operator exclusively:

  • Alteration, falsification, cloning or rewriting of the original factory IMEI on any device. The IMEI is a unique hardware identifier protected by national legislation (in many jurisdictions, including 18 U.S.C. § 1029 in the U.S.; Article 197 ter / 257 of the Argentine Criminal Code; Law 19.223 in Chile; Law 1273 of 2009 in Colombia; among others) and its modification is a federal/serious crime when carried out on stolen devices.
  • Operation against equipment reported as stolen, lost or blacklisted in the national or international IMEI repositories (GSMA Device Registry, national equivalents such as ENACOM/IFETEL/SIIC, operator black-lists).
  • Unauthorized modification of telecommunication networks, including (without limitation) attacks against carrier-side infrastructure, falsification of SIM, eSIM or HLR/HSS records, interception of signaling and SS7/Diameter manipulation, fraudulent operation of mobile virtual networks (MVNOs).
  • Operation on equipment for which the technician does not hold explicit, documented and traceable consent of the legitimate owner.
  • Use in jurisdictions subject to international sanctions (OFAC, EU, UK and equivalents), against blocked persons or for purposes contrary to the prevailing international export-control regime.
  • Resale, sublicensing, lending or mass redistribution of the platform outside the partner program.

5 · Audit trail and chain of custody

Every write operation against the device dispatched through LandBech Tool™ generates a record in the forensic chain of custody of the platform (table forensic_audit_log), with cryptographic SHA-256 hashing chained between rows, time-stamp, technician identifier, IMEI of the device, type of operation and signed declaration under oath. This audit trail is preserved for evidentiary purposes and is available to the competent authorities upon a formal request that meets the procedural and jurisdictional requirements applicable.

6 · Sole responsibility of the operator

The technician operator is the sole and exclusive person responsible for the use given to LandBech Tool™ and for the legitimate origin of the equipment intervened. LandBech Tech Solutions does not control, does not direct and does not endorse the specific operations dispatched by each technician; it merely provides a technical instrumentation platform under the Right-to-Repair framework. Any criminal, civil or commercial responsibility derived from a use not contemplated as legitimate use in clause 3 falls absolutely and irrevocably upon the operator, who expressly releases LandBech Tech Solutions and its representatives, employees and contractors from any claim, lawsuit, complaint or demand of any nature.

7 · Cooperation with authorities

LandBech Tech Solutions cooperates with the competent authorities in the investigation of criminal acts related to the misuse of the platform. Upon a formal request that meets the procedural and jurisdictional requirements applicable, LandBech Tech Solutions will provide the audit evidence preserved (timestamps, technician identifier, dispatched IMEIs, signed payload of the chain of custody), the registration data of the operator and any other data preserved within the legal retention term.

8 · Suspension and revocation of the license

LandBech Tech Solutions reserves the right to suspend or revoke the license, without prior notice and without right to refund of the credits loaded, in the face of well-founded indications of prohibited use (clause 4), failure to comply with the EULA or breach of the present terms. The decision is final from the operational perspective; the technician may resort to the channel legal@landbechtool.com for legal review of the corporate decision.

9 · Third-party trademarks

All brand names, models, logos and patents mentioned on this site (including, without limitation, Apple, iPhone, iOS, Samsung, Galaxy, Knox, Motorola, Moto, Xiaomi, Redmi, HyperOS, Qualcomm, Snapdragon, MediaTek and T-Mobile) are the registered property of their respective industrial-property holders. LandBech Tool™ holds no affiliation, sponsorship, authorization or official commercial relationship with such manufacturers or network operators. The use of those commercial names is made solely and exclusively for descriptive purposes of technical compatibility, under the doctrine of fair use / nominative fair use.

10 · Governing law and venue

These terms are governed by the laws of the United States of America in everything regarding the corporate operation of LandBech Tech Solutions, and by the laws of the technician's residence in everything regarding consumer protection. Disputes are submitted to the competent venue of the technician's domicile.
